Cambue Terms and Conditions
Cambue is currently in Beta release. This means that we are still actively developing, experimenting, and making changes based on user feedback. As such, many things can change without notice. The includes, but is not limited to, changes to features, pricing, data that is stored, how the data is stored.
We recommend that users do NOT rely on Cambue for mission critical data at this point.
During the Beta release, we are offering certain businesses access to the Pro Plan for free. Cambue reserves the right at any point to revoke this free access to the Pro Plan.
Data and Access Storage
Cambue is a tool that helps businesses visualize and plan their costs and revenue. As such, sensitive data like employee names, salaries, and business expenses are stored in Cambue's database. At this point, while the data is only accessible through the application to those who are part of the organization, Cambue's data is accessible and viewable by Cambue and BiteSite staff. This access may be through backend access, or through our Third Party Tools (see below). During this Beta release, we will be monitoring customer feedback to see the need for any further privacy. Should you have any concerns, be sure to reach out to us.
Third Party Tools and Integrations
Cambue uses some third party tools that help our developers gain insight into our user behaviour and help us debug issues and make product decisions. While these tools are extremely useful, it is important for our users to know that some of these tools do record user sessions (in one way or another) while other tools and integrations may use sensitive data. BiteSite Inc. Ownership
Cambue is an application that was built by BiteSite Inc.. As of today, it is still owned by BiteSite Inc. and is controlled by its staff.
Please note that if deemed necessary, BiteSite Inc. staff reserves the right to block access or delete data from the platform. While there may be many reasons we may decide to do this, examples include blocking access from users who are abusive, malicious, or using the platform in a way that we find inappropriate.
Limitation of Liability and Indemnity
BiteSite Inc., and its staff do not accept any responsibility for any damages caused as a result of the information provided by the Cambue software application. It is an informational application meant to aid businesses, but can from time to time present information that may be incorrect. Please take caution in using Cambue in your day to day business.
Users waive and shall not assert any claims or allegations of any nature whatsoever against Cambue or BiteSite Inc, its affiliates or subsidiaries, their sponsors, contractors, advertisers, vendors or other partners, any of their successors or assigns, or any of their respective officers, directors, agents or employees (collectively, the “Released Parties”) arising out of or in any way relating to users' use of Cambue or any Third Party Materials or Third Party Services, including, without limitation, any claims or allegations relating to infringement of proprietary rights, or allegations that any Released Party has or should indemnify, defend or hold harmless users or any third party from any claim or allegation arising from users' use or other exploitation of Cambue or any Third Party Materials or Third Party Services. Users use Cambue or any Third Party Materials or Third Party Services at their own risk.
Without limitation of the foregoing, neither Cambue, BiteSite Inc. nor any other Released Party shall be liable for any direct, special, indirect, incidental, exemplary, punitive, or consequential damages, or any other damages of any kind, including but not limited to loss of use, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way connected with the use of or inability to use Cambue or any Third Party Materials or Third Party Services, including without limitation any damages caused by or resulting from users' reliance on Cambue or any Third Party Materials or Third Party Services or other information obtained from Cambue or BiteSite Inc. or any other Released Party or accessible via Cambue or any Third Party Materials or Third Party Services, or that result from mistakes, errors, omissions, interruptions, deletion of files or email, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of god, communications failure, theft, destruction or unauthorized access to Cambue or BiteSite Inc. or any other Released Party’s records, programs or services.
In no event shall the aggregate liability of BiteSite Inc., whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of or relating to the use of Cambue exceed any compensation paid by users for access to or use of Cambue during the three months prior to the date of any claim. In no event shall Cambue or BiteSite Inc. have or incur any liability, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of or relating to the use any Third Party Materials or Third Party Services.
Users shall defend, indemnify and hold harmless BiteSite Inc. and the other Released Parties from any loss, damages, liabilities, costs, expenses, claims and proceedings arising out of users' use of Cambue or any Third Party Materials or Third Party Services, and if a users is a Subscriber, from users' Customers’ use of the Services and from the use of Cambue or any Third Party Materials or Third Party Services by any person to whom users give access to their accounts (including staff or advisors), including any claims made by any person that any of users', and if a user is a Subscriber, users' Customers’, User Content infringes the rights, including the intellectual property rights, of any third party (collectively, “Indemnified Claims”). BiteSite Inc. reserves the right, in its sole discretion and at its own expense, to assume the exclusive defense and control of any Indemnified Claims. Users agree to reasonably cooperate as requested by BiteSite Inc. in the defense of any Indemnified Claims.
